ALBUQUERQUE — New Mexico Attorney General Hector Balderas and Fifth Judicial District Attorney Dianna Luce announce that the AG’s office will review the shooting death of David Aguilera. DA Luce sent a letter to AG Balderas on June 15, asking him to take over the case due to a conflict in her office.
“We accept this referral and this serious matter will receive a full and timely review,” said Attorney General Balderas.
On May 27, 2022, near Lake Arthur, two Chaves County deputies responded to a subject behaving erratically. The person was identified as 34-year-old David Aguilera. Ultimately, the deputies fired their weapons and Aguilera died as a result of gunshot wounds.
“We are working with the Attorney General’s office to ensure that this case receives the full attention it deserves. Nobody is above the law and we are confident that this will be fully evaluated at the Attorney General’s office,” said DA Luce.
An investigation was conducted by the Roswell Police Department and New Mexico State Police. The Office of the Attorney General will independently review the investigation and determine if criminal charges are appropriate.
