STATEMENT: Attorney General Raúl Torrez’s Statement on the Denial of Fabian Gonzales’ Appeal of His Conviction of Child Abuse Resulting in Death

On August 2, 2022, Fabian Gonzales was convicted of reckless child abuse resulting in death of a child under age 12 and multiple counts of tampering with evidence relating to the death of 10-year-old Victoria Martens. Gonzales filed an appeal in 2022 and today, the New Mexico Court of Appeals affirmed his convictions.

“The denial of Fabian Gonzales’ appeal is the final chapter in the long and painful journey to secure justice for Victoria Martens,” said Attorney General Raúl Torrez. “Today’s decision is also a vindication of the extraordinary work of James Grayson and Greer Staley, two of the most dedicated prosecutors in the history of our state. Although we are reassured that Fabian Gonzales will remain in prison where he belongs, we are mindful of the fact that too many children in our community remain at risk, so I urge the community to be vigilant and report any known acts of child abuse to law enforcement so that we can continue our mission to protect our children in New Mexico.”
