Fighting for New Mexico’s Right to Reproductive Choice

Attorney General Raul Torrez is committed to safeguarding a women’s right to reproductive choice.

In his first several days in office he put that commitment to the test by filing a legal action in our state’s Supreme Court to halt the actions of cities and counties who were unlawfully passing ordinances to restrict reproductive choice in their jurisdictions. On December 13, 2023, AG Torrez gave oral arguments for our case and focused largely on the questions on whether the local ordinances enacted by the counties and municipalities violated the state constitution and state statutes, particularly whether HB 7 (2023) explicitly limits these ordinances.

As we await an order from the high court, we want to remind citizens that the ordinances in question constitute a form of gender-based discrimination and are unconstitutional under the Equal Rights Amendment to Article II, Section 18 of the New Mexico Constitution.
